MapDispatch may modify these Terms of Use from time to time. Your continued use of this website following such a change demonstrates your agreement to be bound by the modified Terms of Use.

Registration

In order to use this web site or certain parts of it, you may be required to register for an account; in this case you agree to provide truthful information when requested.

You are responsible for maintaining the confidentiality of your password, and you will be responsible for all usage of your user account and/or user name, whether authorized or not authorized by you. You agree to immediately notify the site administrator of any unauthorized use of your user account, user name or password.

Intellectual Property

You may not modify, copy, distribute, transmit, display, redistribute, reproduce, publish, license, commercially exploit, create derivative works from, transfer or sell material which may be displayed on the Website from time to time without first obtaining permission to do so from MapDispatch in writing.

Limits to Use

MapDispatch grants you a limited, revocable, nonexclusive license to access the site for your use. You agree that this website may expose you to content that may be objectionable or offensive. The site editor will not be responsible to you in any way for content displayed on this web site, nor for any error or omission.

By using this web site or any service provided, you explicitly agree that:

1. you will not provide any content or conduct yourself in any way that may be construed as: unlawful; illegal; threatening; harmful; abusive; harassing; stalking; tortuous; defamatory; libelous; vulgar; obscene; offensive; objectionable; pornographic; designed to interfere with or disrupt the operation of this web site or any service provided; infected with a virus or other destructive or deleterious programming routine; giving rise to civil or criminal liability; or in violation of an applicable local, national or international law;
2. you will not impersonate or misrepresent your association with any person or entity; you will not forge or otherwise seek to conceal or misrepresent the origin of any content provided by you;
3. you will not collect or harvest any information about other users;
4. you will not provide, and you will not use this web site to provide, any content or service in any non authorized commercial manner, or in any manner that would involve junk mail, spam, chain letters, pyramid schemes, or any other form of unauthorized advertising or commerce; you will not use this web site to promote or operate any service or content without the site editor’s prior written consent;
5. you will not provide any content that may give rise to the site editor being held civilly or criminally liable, or that may be considered a violation of any local, national or international law, including – but not limited to – laws relating to copyrights, trademarks, patents, or trade secrets;
6. you acknowledge and agree that the site administrator will have the right (but not the obligation), at the site administrator’s sole discretion, to refuse to publish, or to remove, or to block access to any content you provide, at any time for any reason, without notice.
7. you acknowledge that the site administrator will have the right (but not the obligation) to delete or modify your account, with or without notice, at any time if it is deemed beneficial to the operation of the site.
8. you will not provide any personal contact information when using the site's messaging features to communicate with movers/dispatchers.

Use of the site beyond the scope of authorized access granted to you by MapDispatch immediately terminates said permission or license.

Service provided

MapDispatch serves as an intermediary between two distinct parties (counterparties), and makes no claims or guarantees regarding either. You agree to accept full responsibility in vetting, selecting, and insuring counterparties you find on MapDispatch, and not to hold MapDispatch responsibility for damages, theft, absence, lost time, or any other negative consequence of a counterparty failing to perform the "move" satisfactorily.

You acknowledge that MapDispatch makes no claims as to the insurance and bonding status, nor operational ability of any counterparty, on the site, nor is responsible for lack therof.

You agree that resolution of any conflicts arising in the performance of any "move" requested and/or accepted on MapDispatch will remain the responsibility of the two parties involved in that transaction, and not MapDispatch. You agree that MapDispatch may, but is not required to, take action, at any time, to refund commissions collected by the site, if the administrator determines the transaction was not completed satisfactorily. MapDispatch is neither responsible nor liable for any additional fees collected (mover fees), or not, during any transaction resulting from a match made on the site.

Refund policy

MapDispatch charges a fee once a move request has been accepted from the mover. That fee is subject to refund in the event that the move is cancelled by the mover, at any time, or the mover "no shows". In some cases, refunds will also be given to cancellations made by the dispatcher, depending on circumstances. Refunds will not be given, "after the fact", once a move has already been completed. Our fee is for matching two independent parties only. At no time will MapDispatch contemplate refunding any money in excess of the amount collected by it in the original transaction.

Privacy

MapDispatch acknowledges that you are concerned about how your information is used and shared and is careful to ensure that such information that comes into its possession is properly looked after. The following policy sets out steps taken to ensure that information provided is kept secure and confidential and is only used for the purposes for which it is provided.

The only personal information that we will collect is the personal information that you provide to us when you register with us or when you communicate with us through our website. We will at any time, at your request, provide you with a copy of any personal information that we are holding about you.

Personal information will be used

1. When you have posted a move, and accepted an offer from a mover, the mover requesting to perform the move will be given your email address, phone number and name only;
2. When, as a mover, you request a move, and your request is accepted, your name, email, and phone number will be provided to the dispatcher;
3. For internal use;
4. To contact you with information relevant to your account.

No personal information will be passed to any third party.

Additional personal information may be requested from you to assist us in resolving any complaints or concerns.

Limitation of Liability

You expressly understand and agree that the site editor will not be liable for any direct, indirect, special, incidental, consequential or exemplary damages; this includes, but is not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the site administrator has been advised of the possibility of such damages), resulting from 1. the use of services or the inability to use services, 2. the cost of obtaining substitute goods and/or services resulting from any transaction entered into on through services 3. unauthorized access to or alteration of your data transmissions, 4. statements by any third party or conduct of any third party using services, or 5. any other matter relating to services.

Disclaimer of Warranties

You agree that use of the MapDispatch site and the service is entirely at your own risk. The MapDispatch site and the service are provided on an "as is" or "as available" basis, without any warranties or any kind. All express and implied warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights are expressly disclaimed to the fullest extent permitted by law. To the fullest extent permitted by law, MapDispatch disclaims any warranties for the security, reliability, timeliness, accuracy, and performance of the MapDispatch site and the service. To the fullest extent permitted by law, MapDispatch disclaims any warranties for the services received through the site.
